Collector Facing FDCPA Class Action For Not Adjusting Post-Judgment Interest Rate
A collection operation is facing a Fair Debt Collection Practices Act class action lawsuit for not adjusting the post-judgment interest rate after the state of Kentucky changed the maximum rate that could be charged seven years ago, according to a copy of the complaint.

A District Court judge in California has granted a defendant’s motion to dismiss after it was accused of violating the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act by attempting to collect on a debt that had been discharged in bankruptcy.
Resolution Introduced in House Condemning CFPB Medical Debt Collection Guidance
A member of the House of Representatives has introduced a resolution calling on Congress to express its disapproval of the Consumer Financial Protection Bureau’s medical debt advisory opinion, which has become the subject of much debate since it was released last month. The resolution was introduced by Rep. Gary Palmer [R-Ala.], who isn’t a member of the House Financial Services Committee or any healthcare committees, has only sponsored four bills this year, but has introduced 37 resolutions in the past five months.
