Consumer Seeks Two-For-One Special in FDCPA Complaint

  • Maybe the consumer was looking to save himself the cost of filing an additional lawsuit in this one by alleging two different collection operations both violated the Fair Debt Collection Practices Act in separate incidents that appear to be completely unrelated to one another — one is accused of failing to properly validate a debt and sending communications with different balances and the other for putting the mini-Miranda disclosure on the section page of a collection letter.

Judge Dismisses FDCPA, FCRA Case Over Who Owed Debt

  • In a case that was defended by Dale Golden and Joe Proulx of Martin Golden Lyons Watts Morgan, a District Court judge in Alabama has granted a defendant’s motion for summary judgment in a Fair Credit Reporting Act and Fair Debt Collection Practices Act case, ruling that an illegible signature on a work order was not sufficient to allow the defendant to determine that the account was someone else’s and not hers.
