Appeals Court Affirms Ruling for Defendant, Holds Reasonable Investigation Doesn’t Need to be Accurate
The Court of Appeals for the Second Circuit has affirmed a lower court’s ruling for a defendant in a Fair Credit Reporting Act case over the reasonableness of a dispute investigation after the plaintiff claimed to be the victim of identity theft. The case was significant enough that it merited an amicus brief from the Consumer Financial Protection Bureau and Federal Trade Commission, who lobbied on behalf of the plaintiff.

A group of lenders are smelling blood in the water surrounding the Consumer Financial Protection Bureau and filed suit against the regulator yesterday, accusing the previous leadership of overstepping its authority in issuing a rule that mandated the same disclosures on Property Assessed Clean Energy (PACE) loans as residential mortgages. As well, a consumer advocacy has published a summary of the status of enforcement actions in the wake of the Bureau dismissing or choosing not to proceed with previously announced cases.
