Suit Accuses Collector of Sending Text After Receiving Refusal to Pay

  • What constitutes a request to cease communication today? And what is a collector allowed to respond if and when a consumer revokes consent? Both of those questions are being tested by a plaintiff, who has accused a collection operation of violating the Fair Debt Collection Practices Act in a pro se lawsuit because of how it responded to a text message the plaintiff sent where he allegedly revoked consent to be contacted.

  • A District Court judge in Washington, D.C. has dismissed a lawsuit accusing a bank of violating the Fair Credit Reporting Act by furnishing inaccurate delinquency information tied to several credit card accounts.

Judge Dismisses FDCPA Lawsuit Claiming Debt Buyer Violated Arbitration Agreement by Filing Collection Suit

  • A District Court judge in Alabama has dismissed a lawsuit accusing a debt buyer of violating the Fair Debt Collection Practices Act by filing a state court collection lawsuit instead of pursuing arbitration under a credit card agreement. The ruling is notable because the court found that merely filing a collection lawsuit, even where an arbitration clause allegedly applies, does not by itself amount to false, deceptive, unfair, or unconscionable conduct under the FDCPA.

New York DFS Fines $2.25M Insurer After Breach Exposed Consumer Data

  • New York’s top financial regulator has fined Delta Dental Insurance Company and Delta Dental of New York $2.25 million after finding the companies failed to maintain adequate cybersecurity controls and delayed reporting a major data breach tied to the widespread MOVEit software hack.
