FDCPA Suit Accuses Collection Law Firm of Submitting Faulty Affidavit
A collection law firm is being sued for allegedly violating the Fair Debt Collection Practices Act and state law in Georgia because it used a “false and misleading” affidavit to attest to the existence of a debt in a collection lawsuit. Among the allegations that purportedly made the affidavit false and misleading was a claim about the penmanship of the individual who notarized the document.

Judge Dismisses Suit Over Email Only Request, $0.38 Difference in Debt
A District Court judge in New Jersey has granted a motion to dismiss filed by the defendants in a Fair Debt Collection Practices Act case, ruling that responding to a request for email communication only with a letter and purportedly misstating the amount that was due by $0.38 is insufficient for the suit to proceed.
Collection Calls Hit Peak
Debt collection calls are rising sharply in 2025, according to a new analysis of Federal Trade Commission complaint data by NumberBarn. In the first quarter of 2025 alone, consumers filed 112,583 complaints related to debt collection calls, a 150% increase from the 44,999 reports filed during the same period in 2024.
