Webinar Recap: What It’s Like to Collect in California Today
California continues to present unique and escalating challenges for companies in the credit and collection industry. In this live panel discussion, industry experts and legal professionals from across the state broke down what’s happening on the ground — from regulatory examinations to evolving legislative priorities — and how companies can better prepare to do business in the Golden State.
With the California Department of Financial Protection and Innovation (DFPI) ramping up its oversight, many collection agencies are facing increased scrutiny, in-person audits, and significant compliance costs. As the state adjusts to new legislative and regulatory norms, especially in healthcare and licensing, companies must stay nimble and informe
3 Takeaways for Your Operation
1. DFPI exams are increasing and expensive
Agencies report in-person visits with multiple examiners charging $120/hour per person, with invoices reaching $23,000+. Examiners are reviewing everything from call recordings to bank ledgers and email templates. Agencies should prepare early using the 85-question multistate audit questionnaire now in circulation.
2. New medical debt rules make debts unenforceable without proper disclosures
SB 1061 requires medical providers to give specific written disclosures to patients at the time of service. Debts lacking this disclosure are void and uncollectible, even before being sent to collections. Agencies must educate and revise client contracts immediately.
3. Stay involved and build relationships
Panelists emphasized the importance of joining advocacy groups (e.g. CAC, RMAI), staying on top of DFPI updates, and contributing to legislative discussions. The upcoming September 30 fee structure release will likely shape 2026’s advocacy priorities.
For those collecting in California, “challenging” was the word echoed by all — but also a reminder that preparation, collaboration, and smart compliance strategy can make all the difference.
