Texas Appeals Court Affirms Attorney’s Fee Award Against FDCPA Plaintiff

• A Texas State Appeals Court has upheld a ruling in favor of a collection operation and a ruling that ordered the plaintiff to cover the defendant’s attorney’s fees in a Fair Debt Collection Practices Act and Texas Deve Collection Act case, rejecting a wide-ranging appeal that included accusations of misconduct, evidentiary errors, and judicial bias.

Florida Senate Bill Targets Medical Debt Collection

• A new year means new legislatures that are in session in state capitols across the country. A bill has been introduced this week in the Florida Senate that seeks to set definitions for a number of terms, such as medical debt collector and “extraordinary collection action.” Senate Bill 1222 would make a series of changes to how medical debt is defined, transferred, and collected in Florida, signaling continued state-level interest in regulating medical debt practices more aggressively.

Judge Rejects Bid to Dismiss FCRA Case Over Missing Credit Report Details

• A District Court judge in Florida has denied a defendant’s motion for judgment on the pleadings in a Fair Credit Reporting Act case over the information that was included, and not included, on the plaintiff’s credit report, finding that the plaintiff plausibly alleged the credit reporting agency failed to disclose all information contained in her file as required by federal law.
