Collector Sued for Not Honoring Refusal to Pay Sent Via Text

  • This is something that comes up often during webinars on the topic of digital communications, especially those made via email and text messaging. A collection operation is facing claims it violated the Fair Debt Collection Practices Act by not honoring a request from the plaintiff to cease communications that was sent via text message because, according to the complaint, the defendant did not monitor inbound messages it received.

Judge Dismisses FDCPA Claims Against Collection Law Firm Over Jurisdiction Dispute

  • A District Court judge in New York has granted a motion to dismiss filed by a collection law firm that was sued for violating the Fair Debt Collection Practices Act after filing a collection lawsuit in the wrong jurisdiction, ruling that the court lacked personal jurisdiction over the defendant. Judge Orelia E. Merchant of the District Court for the Eastern District of New York issued the ruling, determining that the plaintiff failed to establish sufficient connections between the law firm and the state of New York to justify her authority over the defendant.
