Complaint Accuses Collector of Not Responding to ID Theft Claim, Dispute

  • Claims that an individual is the victim of identity theft are no joke. Getting to the bottom of the situation is not always easy. A collection operation is facing claims it violated the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, and state law in North Carolina because it had yet to respond to the plaintiff’s claim that he was the victim of identity theft in four months after the plaintiff submitted his evidence.

DOJ Presses Fed on Profit Status as CFPB Warns Funding Could Run Out Within Weeks

  • The Justice Department has asked Federal Reserve Chair Jerome Powell to clarify whether the central bank has returned to profitability, a determination the Trump administration says could dictate whether the Consumer Financial Protection Bureau may legally receive funding. The exchange comes as the CFPB warns it may run out of money in as little as two weeks and has notified staff of potential job cuts.

Judge Denies MTD FCRA Claim Over Allegedly Incomplete Consumer File

  • A Magistrate Court judge in Florida has denied a defendant’s motion to dismiss claims it violated the Fair Credit Reporting Act on the grounds that at this stage of the proceedings, the plaintiff’s claims have to be accepted as true. The decision keeps alive a lawsuit centered on what information must be included when a consumer reporting agency provides a copy of a consumer’s file.

New NCLC Report Gives Nine States Fs on Consumer Asset Protections

  • A new report from the National Consumer Law Center says no state in the country meets five basic standards for protecting consumers’ income and property from seizure by creditors, debt buyers, or collection agencies. The No Fresh Start 2025 report, released this week, evaluates exemption laws across all 50 states plus the District of Columbia, Puerto Rico, and the Virgin Islands, assigning letter grades to each jurisdiction.

Wisconsin Appeals Court Tosses $70K Fee Award in FDCPA Case

  • A Wisconsin Appeals Court has reversed a lower court’s ruling awarding more than $70,000 in fees and costs in a Fair Debt Collection Practices Act case, concluding that the trial court improperly granted fees tied to a previously dismissed federal action and failed to make necessary factual findings when calculating fees in the state case.
