N.Y. Appeals Court Joins Majority in Rejecting Hunstein-Based FDCPA Claims
In a case that was defendant by Jonathan Robbin at J. Robbin Law, A New York Appeals Court has reversed a lower court’s ruling and granted a defendant’s motion for summary judgment in a Hunstein third-party disclosure case, ruling that the use of a mail vendor to contact a consumer in a legitimate attempt to collect a debt is “not a practice the [FDCPA] was meant to prohibit.”

Credit Repair Organizations (CROs) are a constant presence in the credit and collections landscape, often acting as intermediaries between consumers and creditors. In this webinar, a panel of experts—Tonia Brown, Scott Dellaventura, and Randi Gabel—shared insights on how agencies can navigate these relationships effectively while maintaining compliance and protecting recoveries.
Panelists noted that while CROs promise consumers improved credit scores or debt resolution, the reality is often far less effective, with many consumers paying high fees and seeing little or no improvement. This gap between expectations and outcomes can lead to frustration and mistrust—both toward the CRO and the creditor or agency.

Ultimately, while you are not legally required to work with CROs, doing so strategically can help recover balances and reduce consumer hostility. The key is balancing compliance, clear documentation, and consumer-centered communication to turn challenging CRO interactions into workable outcomes.
