RMAI, ACA Challenge California Licensing Fees as ‘Unlawful Tax’
RMAI, in conjunction with ACA International and a collection operation based in California this week filed a lawsuit against California’s Department of Financial Protection & Innovation challenging the licensing fees being assessed by the regulator. The case, filed in California state court, seeks to invalidate the fee structure under the state’s Debt Collection Licensing Act, arguing that the assessments imposed on licensed businesses are excessive, unpredictable, and unconstitutional.
Arbitration Wins Hold Firm as Court Denies Challenge to FDCPA Claims
Live by the arbitration, die by the arbitration, a state court judge in Delaware has ruled, denying a plaintiff’s motion to overturn a ruling in favor of a defendant that was accused of violating numerous statutes, including the Fair Debt Collection Practices Act, after an arbitrator awarded the defendant the vehicle in question and $24,000 in costs.
No Inaccuracy, No Claim: Court Dismisses FCRA Case Tied to Missed Payments During Insurance Dispute
A District Court judge in Texas has granted a defendant credit union’s motion to dismiss charges it violated the Fair Credit Reporting Act over how it furnished information to the credit reporting agencies after an insurance company admitted it failed to make a payment because of a system error.
